124-6          TEFRATax Equity and Fiscal Responsibility Act MEDICAID ELIGIBLE CHILD TAKEN INTO OCSOffice of Children's Services CUSTODY

 

In the rare instance that a child receiving TEFRATax Equity and Fiscal Responsibility Act Medicaid is taken into custody, the child's TEFRATax Equity and Fiscal Responsibility Act Medicaid case should be changed to a Title IV-E case. It is very important for OCSOffice of Children's Services to communicate with DPADivision of Public Assistance by emailing DOSTDivision Operations Support Team when it is anticipated the child will return home. DOSTDivision Operations Support Team will notify the TEFRATax Equity and Fiscal Responsibility Act caseworker to take appropriate action on the case. OCSOffice of Children's Services will provide DPADivision of Public Assistance as much notice as possible so that the TEFRATax Equity and Fiscal Responsibility Act caseworker can review the past Medicaid case and determine what is needed to re-open the TEFRATax Equity and Fiscal Responsibility Act Medicaid case, such as a level of care determination by Comagine Health or a disability decision by Disability Determination Service.
