120-3 FEE AGENT SELECTION
When individuals call to express interest in working with DPA as a fee agent, certain guidelines must be followed to ensure the necessary paperwork and training are completed. The list below outlines the steps to follow when selecting fee agents.
DOST will contact either the references provided by the fee agent on the application form or other references available in the community. DOST staff will also conduct additional check using interfaces available to DPA such as EIS to disqualify individuals from becoming a fee agent if they have been convicted of fraud in a court hearing, judged to have committed fraud in an administrative disqualification hearing, or signed a waiver of the right to a disqualification hearing.
DOST staff may develop their own interview questions to determine if the potential applicant will be successful as a fee agent. Some questions to ask in making a decision include asking about the following:

An individual or agency that is interested in being or having Fee Agent representation must first express interest to DPA . Once interest is expressed, DOST sends a Fee Agent Application (FA 50 ) to the individual or individual acting on behalf of the organization. DOST conducts an interview with the interested individual and completes the reference checks.
After a candidate is selected, DOST sends a Fee Agent Provider Agreement (FA 33 ), Fee Agent and HIPAA information, and other forms and materials to the individual. The FA 33 outlines the fee agent's services to be performed, their role and expectation as a fee agent, confidentiality and conflict of interest rules, payment level for work conducted, length of the contract, and termination rules.

The Substitute Form W-9 is required for all individuals or organizations that will receive compensation as a fee agent from DPA . If the individual is working for an agency in a fee agent capacity, the organization will be paid and the Substitute Form W-9 must be completed for the agency by the agency's representative.
DOST signs the agreement upon the individual's complete of the trainings, keeps the original agreement, and sends a copy of the agreement to the new fee agent.
DOST updates the active Fee Agent Master List on SharePoint to include the new fee agent.
