5410           ELIGIBILITY DETERMINATION FOR UNDER 21 MEDICAID

 

5410 A.      NON-FINANCIAL ELIGIBILITY

 

To be eligible for Under 21 Medicaid, individuals must be under the age of 21 and meet the Family Medicaid non-financial eligibility requirements of citizenship (including the CSSD statement), residency, and enumeration.  The Family Medicaid requirements of deprivation, living with a caretaker relative and age do not apply.

 

5410 B.      FINANCIAL ELIGIBILITY

 

To determine financial eligibility for Under 21 Medicaid, take into consideration the needs, income and resources of the child and members of the child's household who are his or her parents and/or siblings.  If the income of a stepparent or sibling causes the household to exceed the income limit, the needs and income of the sibling and/or stepparent are removed, and eligibility is redetermined (see examples in section 5340 (B).  Countable income is determined by following Family Medicaid rules, except for those rules excluded in section 5020.

 

Note:

The income and resources of adoptive parents are not considered when determining Under 21 Medicaid eligibility for a child under the age of 18 who is eligible to receive state-only adoption assistance.  See Section 5460.
