5430           MARRIED INDIVIDUAL UNDER 21

 

When an individual is married and is living with his or her spouse, the income and resources of both the individual and the spouse must be used to determine the individual's Medicaid eligibility.  The appropriate Family Medicaid AI need standard is used to determine eligibility for these individuals.

 

Note:  

If the married couple lives with the applicant's parent(s), the income and resources of both the parent(s) and the spouse must be included in the determination.

 

Example 1:

The household consists of a 19-year-old female and her 22-yearold spouse.  The income and resources of both must be considered in determining Medicaid eligibility for the 19-year-old female because her spouse's income and resources are considered to be available under federal Medicaid rules.  The countable income is compared to the Family Medicaid AI 02 standard.

 

Example 2:

The household consists of a 19-year-old male and his 23-yearold spouse who are living with his parents.  The needs, income, and resources of both the parents and the spouse must be considered in determining eligibility for the 19-year-old.  The need standard is Family Medicaid AI 04.
