713-8 CITIZENSHIP FOR CERTAIN CHILDREN BORN OUTSIDE THE UNITED STATES
Effective February 27, 2001, the Child Citizenship Act of 2000 allows a child born outside of the United States to acquire citizenship of the United States automatically when all of the following conditions have been fulfilled:
At least one parent of the child is a citizen of the United States, whether by birth or naturalization;
The child is under the age of eighteen years; and
The child is residing in the United States in the legal and physical custody of the United States citizen parent; pursuant to a lawful admission for permanent residence.
Note:
Because proof of citizenship is not automatically issued to eligible children,
parents must provide proof of the child's relationship (such as a birth
certificate) to their U.S .
citizen parent and proof that the child is lawfully admitted into the
U.S. Parents of
a foreign born child who meet the conditions of the new law should be
encouraged to apply for a certificate of citizenship for their child with
the USCIS and/or a passport
for their child with the Department of State.
