5162-7 INCOME OF SSI Supplemental Security Income/APA RECIPIENTS
5162-7 A. FINANCIALLY SEPARATE HOUSEHOLDS
All income of any person who is actually receiving SSI Supplemental Security Income, or SSI Supplemental Security Income and APA , or APA only, and who is living in a Family Medicaid household and a member of the Family Medicaid household will be disregarded in determining the eligibility of applicants and recipients. Interim Assistance payments are not considered an APA benefit for Family Medicaid purposes.
SSI Supplemental Security Income/APA and Family Medicaid persons living together will be treated as completely separate households, regardless of the legal or family relationships between them. No person may receive SSI Supplemental Security Income/APA and Family Medicaid benefits in the same calendar month.
5162-7 B. FAMILY MEDICAID APPLICANTS WITH SSI Supplemental Security Income/APA RECIPIENTS
The caseworker will not count as Family Medicaid income the total amount of income determined by SSI Supplemental Security Income/APA as belonging only to the SSI Supplemental Security Income/APA eligible person. Verification of sources and amounts of SSI Supplemental Security Income counted income must be obtained from SSI Supplemental Security Income/APA case files, EIS Eligibility Information System Interfaces, computer printouts, or the servicing SSI Supplemental Security Income office.
SSI Supplemental Security Income/APA considers portions of the income of the SSI Supplemental Security Income/APA ineligible spouse or ineligible parent of a child under 18 to be available to the SSI Supplemental Security Income/APA applicant. SSI Supplemental Security Income/APA cannot "deem" income that has been considered in determining Family Medicaid. In making the Family Medicaid determination, all income "deemed" by SSI Supplemental Security Income/APA to be available to the SSI Supplemental Security Income/APA recipient will be considered Family Medicaid income unless it is otherwise not countable. The caseworker should not concern himself with the net amounts SSI Supplemental Security Income deemed, after deeming disregards, but merely identify the recipient's own income and consider the gross amounts of all other deemed income as available to the Family Medicaid household.
5162-7 C. FAMILY MEDICAID APPLICANTS WITH POTENTIAL SSI Supplemental Security Income/APA ELIGIBILITY
Any Family Medicaid applicant who resides with an adult or child who has potential eligibility for the SSI Supplemental Security Income/APA program should be referred to SSI Supplemental Security Income to make application(s) if it would be to the household's financial advantage.
5162-7 D. CLIENT RESPONSIBILITY TO REPORT RECEIPT OF SSI Supplemental Security Income
The Family Medicaid recipient or applicant is required to notify DPA within 10 days after a member of household or household begins receiving SSI Supplemental Security Income benefits. Application for SSI Supplemental Security Income benefits is not a condition of Family Medicaid eligibility. If all or any of the persons in a Family Medicaid applicant or recipient household appear to have SSI Supplemental Security Income/APA eligibility, they must be informed of their potential.
5162-7 E. LAST OR ONLY DEPENDENT CHILD WHO RECEIVES SSI Supplemental Security Income
If the last or only dependent child in a Family Medicaid household begins receiving SSI Supplemental Security Income benefits, no Family Medicaid eligibility exists for that child. (See section 5104-5) If a stepparent or alien sponsor begins to receive SSI Supplemental Security Income, deeming of income to the stepchildren or alien stops.
