5150-1 AVAILABILITY OF A RESOURCE
For purposes of
determining Family Medicaid eligibility, a resource must be actually
available to meet the needs of the child. Under this requirement
the resource must be in cash or it must be readily convertible to cash.
If real property
appears to have a value (see below) in excess of the resource limit, an
applicant may still be considered eligible if he provides verification
that:
The property
is not available because it is jointly owned and the other (non-client)
owner will not agree to sell his portion; or
The property
has uncorrectable legal or physical defects which prevents it being sold.
If either of the requirements above are met, the resource will be considered as unavailable to meet the needs of the applicant's dependent children. It will be considered exempt as long as either of these conditions are met.
