125-6 IAInterim Assistance FAIR HEARING PROCESS
Clients have the right to file a fair hearing if their disability claims has been denied. Refer to MS 117 for more information on DPADivision of Public Assistance's fair hearing process.
Role of the IAInterim Assistance Medical Reviewer during the fair hearing process:
- As the agency's main witness, the IAInterim Assistance Medical Reviewer represents DPADivision of Public Assistance in the fair hearing while working closely with DPADivision of Public Assistance's fair hearing representatives. The IAInterim Assistance Medical Reviewer provides explanations and clarifications, and answers questions raised by the client and the Administrative Law Judge.
- The IAInterim Assistance Medical Reviewer is also responsible for providing a copy of the following information for the fair hearing:
- The client's entire medical file.
- A detailed explanation and justification as to why the client does not meet the disability requirement for IAInterim Assistance, and the SSASocial Security Administration listing of medical impairments.
