115-6          CHILD SUPPORT ENFORCEMENT

The purpose of Child Support Enforcement Division (CSEDChild Support Enforcement Division) in the Alaska Department of Revenue, is to promote parental responsibility by enforcing court orders of child support, collecting the support payments, and disbursing these payments to the caretaker relatives of children.

115-6 A.      ALASKA TEMPORARY ASSISTANCE

It is the responsibility of CSEDChild Support Enforcement Division with respect to the Alaska Temporary Assistance program to receive the child support payments on behalf of the Alaska Temporary Assistance recipients.

CSEDChild Support Enforcement Division will initiate collection activities against the non-custodial parents of children who are not making contributions. It will also identify and locate non-custodial parents when such action will be to the children's best interests.

See Alaska Temporary Assistance Program Manual Section 717.

Note:

This service is available to anyone. Households who do not receive Alaska Temporary Assistance should also be referred to CSEDChild Support Enforcement Division.

115-6 B.      MAGIModified Adjusted Gross Income MEDICAID

MAGIModified Adjusted Gross Income Medicaid requires that each applicant or recipient assigns to the Department of Health all rights to medical support and payments for medical care from any third party, including health insurance benefits available to the Medicaid applicant or recipient from a non-custodial parent.

Medical rules require caretaker relatives to assign their rights to any medical support from all sources to the state while they are receiving Medicaid, and to cooperate with CSEDChild Support Enforcement Division in establishing paternity, identifying and locating the child's non-custodial parent, and obtaining medical support for the child.

Assignment of rights ends when the recipient's eligibility for Medicaid ends.

See MAGI Medicaid Manual Section 812 and Aged, Disabled, and Long Term Care Medicaid Manual Section 511.
