111-8          FAIR HEARING REQUESTED TO DISPUTE A CLAIM ACTION

 

An individual can request a fair hearing to dispute any action taken regarding the establishment of an Alaska Temporary Assistance, Adult Public Assistance, Senior Benefits or SNAP claim or any action taken by the Claims Specialist, Benefit Issuance and Recovery Unit, to enforce repayment of a claim.

 

The DPA office will notify the DOST fair hearing representative and the Claims Specialist in the Benefit Issuance and Recovery Unit of the fair hearing request.  If an individual requests a fair hearing through the Benefit Issuance and Recovery Unit, the Claims Specialist will notify the DOST fair hearing representative and pend the claim for the outcome of the fair hearing decision.

 

These notifications will be sent by e-mail within five calendar days of receiving the fair hearing request.  The e-mail message must include the individual's name, case number, program for which the hearing request was made, date the fair hearing request was received, reason for the fair hearing request, and whether the individual is requesting reinstatement of recouped benefits pending the fair hearing decision.

 

The DOST fair hearing representative will act as the agency's representative at the fair hearing and may request copies of any information contained in the individual's claim case file.  The fair hearing representative may request that the Claims Specialist be present at the hearing.
