770-5          INELIGIBLE ALIENS

 

Non-qualified aliens and qualified aliens that are subject to but have not yet met the 5-year waiting period are not eligible for ATAPAlaska Temporary Assistance Program and not referred to Work Services for case management.

 

The resources and income of an ineligible alien parent/caretaker are considered wholly available to the household, and a portion of their income and resources are included in calculating the payment determination. An ineligible alien parent/caretaker is allowed the work incentive deductions detailed in ATAPAlaska Temporary Assistance Program MS 760 when calculating the amount of income available to the assistance unit.  

 

If the ineligible alien is a dependent child, they are excluded from the assistance unit and their resources and income are excluded.

 

Note:

In EISEligibility Information System, an ineligible alien parent/caretaker is coded 'PA'. If the ineligible caretaker is not a mandatory household member, they are excluded from the assistance unit entirely and coded 'OU'.

In EISEligibility Information System, an ineligible alien child is coded 'OU'.
