Real property that the household is making a good faith effort to sell at a reasonable price is exempt.

 

      • A "good faith effort" means that the property is continuously and actively offered for sale at a reasonable price. 

      • "Reasonable price" means it is priced equivalent to the prices of similar pieces of property in the area, and the offer to sell invites additional reasonable offers. 

      • Actively offered for sale means that the property is listed with realtors or real estate agents, or is offered privately by at least monthly classified newspaper ads or online electronic ads and a visible “for sale” sign must be posted on the property.

 

Verification of "reasonable price" and "actively-offered for sale" is required.

Note:

Examples of acceptable forms of listings are websites, newspaper ads, bulletin board postings, realtor listings, etc. With technology changing at a rapid pace, and will be constantly throughout the years, internet sites such as Craigslist, Sell.com, FSBO.com, Zillow, and other ad listing websites are acceptable forms of good faith efforts to sell. The caseworker will need to use PPJPrudent Person Judgement in researching ads on internet sites and checking for how actively the client is pursuing the sale of the property at application and recertification. It is also recommended that a hard copy of the ad be printed out and kept in the case file
