608-1          FAIR HEARINGS

 

Households may request a fair hearing on any action taken by the agency that affects the household's participation in SNAPSupplemental Nutrition Assistance Program.

 

If the household requests a fair hearing before the effective date of the action (the date the benefits are to be reduced or stopped) and its certification period has not expired, we would continue their SNAP benefits at the previously authorized amount pending a fair hearing decision, unless otherwise declined by the household.

 

Hearings procedures are detailed in the Administrative Procedures Manual at section 117-2.

 

608-1 A.     TIME FRAMES

 

Hearings must be requested within 90 days of the date of action, either verbally  or in writing to any employee of the Division.   

 

A hearing requested to dispute a denial for restored benefits (lost more than 90 days but less than one year from the date of the request) is granted provided the hearing is requested within 90 days of the date the agency denied the request for the restored benefits.

 

Households may request a hearing at any time within a certification period to dispute its current level of benefits.

 

Hearings must be completed and the household informed of the decision within 60 days of the date the hearing request was received in the DPADivision of Public Assistance office.
