5016-1 INFORMING APPLICANTS AND RECIPIENTS ABOUT MEDICAL SUPPORT ORDERS AND REQUIREMENTS
When an initial application is received and when a recipient requests that a child be added to the case, the caseworker must discuss medical support cooperation and enforcement requirements with caretaker relatives who are required to cooperate and provide them with:
A Child Support
Information form ( CSSD 1603a) to
complete for each noncustodial parent not living in the home of the
dependent child;
Written notice
of the caretaker's right to claim good cause for not cooperating with
CSSD (provided on the DPA
application and the Child Support Information form);
A Child Support
Cooperation Statement (GEN 80 or EIS
notice M060) for caretakers to complete if they choose not to provide
the information requested on the Child Support Information form and
want to claim good cause; and
An opportunity to request that CSSD keep the household’s address confidential because of a threat to their well-being. The Release of Information form ( CSSD 0500b) is used for this purpose. In addition, CSSD will provide the caretaker with an Affidavit for Address Confidentiality when the medical support case is opened. These forms are used to keep identifying information from being released to a person (such as a parent) who would otherwise be entitled to have information about the medical support case.
Note:
The requirement to discuss medical support cooperation and enforcement
requirements, including the completion of a CSSD 1603a does not apply
to the adding of a newborn until after the end of the mother's 60-day
post-partum period.
Note:
Enrollment of a child in Medicaid or Denali KidCare does not satisfy the
noncustodial parent’s obligation of providing medical support. If
that occurs, the noncustodial parent will be required to repay the state
for the cost of services provided to the child covered by Denali KidCare
or Medicaid if those services should have been provided under the medical
support order (i.e., dependent care coverage under the noncustodial parent’s
health insurance).
