5104-1        MANDATORY HOUSEHOLD MEMBERS

 

Eligibility for Family Medicaid requires that a dependent child and a specified relative be present in the home.  See Section 5120 for the “specified relative” requirement.  If the specified relative is a parent, both the child and the parent must have their need for Medicaid coverage considered in the household unless the parent is receiving SSI Supplemental Security Income or APA .  If brothers or sisters of that dependent child who are themselves a dependent child are living in the same household, those children must also have their need for Medicaid coverage considered in the household.

 

Dependent Child means a child who is:

 

  1. Under age 18 years, or age 18 and enrolled full-time in a high school, GED General Equivalency Diploma program, or a vocational or technical training program and is expected to graduate or complete the course of study before or during the month of the child’s 19th birthday (see section 5013); and
     

  2. Is deprived of parental support and care (see Section 5125).

 

Parent means an individual of any age who is the natural or adoptive mother or father of the dependent child.  An individual may be a parent and a dependent child at the same time.  In Family Medicaid unemployed parent cases (see Section 5125-2), both natural or adoptive parents must be included in the eligibility unit, even if they are not married, unless one of the parents is excluded for a reason stated in Section 5104-6.

 

Brothers and sisters mean blood-related or adoptive siblings.  This includes half-brothers and half-sisters, but excludes stepbrothers and stepsisters.
