124-6           TEFRA Tax Equity and Fiscal Responsibility Act MEDICAID ELIGIBLE CHILD TAKEN INTO OCS Office of Children's Services CUSTODY

In the rare instance that a child receiving TEFRA Tax Equity and Fiscal Responsibility Act Medicaid is taken into custody, the child’s TEFRA Tax Equity and Fiscal Responsibility Act Medicaid case should be changed to a Title IV-E case.  It is very important for the OCS Office of Children's Services eligibility technician to communicate with the TEFRA Tax Equity and Fiscal Responsibility Act team or caseworker when it is anticipated the child will return home.  The OCS Office of Children's Services eligibility technician should give the TEFRA Tax Equity and Fiscal Responsibility Act team or caseworker as much notice as possible so that the TEFRA Tax Equity and Fiscal Responsibility Act caseworker can review the past Medicaid case and determine what is needed to re-open the TEFRA Tax Equity and Fiscal Responsibility Act Medicaid case, such as a level of care determination by Qualis Health or a disability decision by Disability Determination Service.
