117-7 POSTPONEMENTS
A client may request and is entitled to one postponement of the hearing without prior approval from the hearing authority. The postponed hearing must be scheduled within 30 days from the originally scheduled hearing date. The DPA hearing representative must inform the client and/or client representative that the timeframe for the hearing authority to make a decision is extended for the same number of days as the hearing is postponed by client request.
Additional postponements, or additional time added to an original postponement may be granted by the hearing authority only if good cause exists. Good cause will have to be established before the hearing authority's approval for postponement.
The agency may not request postponement of the fair hearing date for any reason.
