470-2 CONTINUED BENEFITS FOR TEMPORARILY INSTITUTIONALIZED RECIPIENT
An APAAdult Public Assistance recipient may continue to receive full APAAdult Public Assistance benefits for up to 3 months while living in an eligible institution. To qualify for continued full APAAdult Public Assistance benefits, the individual must meet and fulfill all of the following requirements:
- The individual must be eligible for APAAdult Public Assistance benefits in the month that they enter the eligible institution. Individuals who are SSISupplemental Security Income recipients must also continue to receive SSISupplemental Security Income benefits in order to qualify for continued APAAdult Public Assistance benefits under this provision.
- The individual must continuously reside throughout the affected month in one or more eligible institution.
- A physician must certify, in writing, that they expect that the individual will live in the eligible institution for 90 days or less. The physician must submit the certification no later than the 90th day of admission to the eligible institution or by the day of release, whichever is earlier. The Facility Verification Form (MED 12) may be used for this purpose.
- The individual must demonstrate that they need to pay some or all the expenses of maintaining a home or living arrangement to which they intend to return. A written statement which specifies this need is enough to verify the individual's need to maintain a home or living arrangement, unless the case worker has reason to believe otherwise.
Individuals expected to be living in an eligible institution for more than 3 months will have their APAAdult Public Assistance eligibility measured against the $200 monthly NHPNursing Home Personal Needs (APA Household Type) income limit. If they have countable income equal to or above $200, they are not eligible for APAAdult Public Assistance benefits.
