117-3          REAPPLICATION FOR BENEFITS PENDING THE FAIR HEARING DECISION

 

A client requesting a fair hearing may reapply at any time and have their eligibility and benefit amount determined based on the information in the application.  This may result in reinstatement of benefits if benefits were not continued, or this may establish a period of ongoing eligibility and possibly a new benefit level even though benefits had been continued at a prior level.  

 

If a client who is receiving continued benefits chooses to reapply and the reapplication establishes ineligibility or a lower benefit level, benefits must continue to be issued at the previous level until a hearing decision is made. A new application will also assist the client in establishing facts and ongoing information necessary for calculating the correct amount of benefits after the hearing decision is rendered.
