The Department of Law, Office of Special Prosecutions and Appeals, conducts criminal prosecution of welfare fraud. The Office of Special Prosecutions and Appeals accepts referrals only from DPADivision of Public Assistance's Fraud Control Unit.

 

Note:

Caseworkers are not to refer cases directly to the Department of Law.

 

The FCUFraud Control Unit carefully selects cases for referral to the Department of Law for criminal prosecution. If the prosecutor decides not to proceed with the case, it is returned to the Fraud Control Unit with an explanation of why it was not accepted for prosecution. The Fraud Control Unit then determines if there are still grounds to prove fraud through the Administrative Disqualification Hearing process.
