MANUAL: Aged, Disabled and Long Term Care Medicaid Eligibility Manual

Beginning December 19, 2009, Afghan and Iraqi special immigrants are treated the same as refugees and are not subject to a five-year bar. Other changes are either technical in nature or clarifications that are the result of policy questions or suggestions from the field.

OVERVIEW OF CHANGES
MS 514 D Penal Institution
Removes policy that an individual on electronic monitoring is an inmate in a penal institution, and clarifies that such individuals are not considered to be incarcerated.
MS 516 Retroactive Medicaid
Clarifies that the recipient is responsible for the unpaid medical bills until the provider has been given evidence of eligibility and agrees to accept payment by billing Medicaid for the service.
MS 520 B U.S. Citizenship and Eligible Alien Status
Clarifies that an authorized member of a tribal health organization may also verify original or certified copies of citizenship and identity documents.
MS 528 D General Trust Provisions
Clarifies the steps a caseworker must take if it appears that a trustee is mismanaging a trust in a way that could cause Medicaid ineligibility.
MS 534 E Premiums May Be Required
Clarifies that a caseworker must make sure a previous Working Disabled Medicaid Buy-In case was not closed for failure to pay premiums. These back premiums must be paid before a new Working Disabled Medicaid Buy-In case is opened.
MS 570 C Individuals Not Subject to Cost of Care
Updates the example to explain that the recipient is still eligible for APA in July because of adverse action notice requirements.
MS 580 C Qualified Disabled and Working Individuals
Corrects the resource limits to be twice the SSI resource limits ($4,000 for individuals and $6,000 for couples). A previous manual change incorrectly applied higher resource limits to this coverage group.
Addendum Addendum 1
Removes QDWI from the resource limit table.
Corrects 2009 maximum community spouse resource allowance.
Updates the 2010 Medicaid part D subsidy amount.
Revises the 2010 Pickle Amendment Table.
Addendum Addendum 2
Updates QM and SL Medicaid subtypes to show the resource limits for 2010.
